Maryland law defines harassment as follows: A person may not (1) follow another in or about a public place, (2) conduct visual surveillance of an area of another’s residence where the other has a reasonable expectation of privacy, or (3) maliciously engage in a course of conduct that alarms or seriously annoys the other

if all three of the following elements are present:

  • with the intent to harass, alarm, or annoy the other;
  • after receiving a reasonable warning or request to stop by or on behalf of the other; and
  • without a legal purpose.

 

“Residence” includes the yard, grounds, outbuildings, and common areas surrounding a home. The statute explicitly protects constitutionally protected activities, such as peaceable political expression or providing information to others, and may not be applied in a way that infringes on rights guaranteed by the United States Constitution or the Maryland Declaration of Rights.

Penalties for Harassment in Baltimore County

Harassment is a misdemeanor with penalties that increase for repeat offenses:

  • First offense: imprisonment not exceeding 90 days, a fine not exceeding $500, or both.
