What Is a Violation of Probation in Maryland?

In Maryland, probation is a court-ordered period of supervision that allows you to serve part or all of your sentence in the community instead of jail. A violation of probation occurs when you allegedly fail to comply with any condition of that probation. Violations generally fall into two categories:

  • Technical violations — Minor breaches such as missing appointments with your probation officer, failing a drug or alcohol test, not paying restitution or fines, or failing to complete court-ordered treatment or community service.
  • Non-technical (substantive) violations — More serious matters such as being arrested or charged with a new crime, violating a no-contact or stay-away order, or absconding from supervision.

Under Maryland law, the State must prove the violation by a preponderance of the evidence (a lower standard than “beyond a reasonable doubt”). At the VOP hearing, the judge has broad discretion to revoke probation and impose any or all of the original suspended sentence.

Penalties for Violation of Probation in Baltimore County

Penalties depend on the type and number of violations:

  • Technical violations are now subject to presumptive caps: up to 15 days for a first violation, 30 days for a second, and 45 days for a third. A fourth or subsequent technical violation can result in the full remaining suspended sentence.
  • Non-technical violations have no cap — the judge may revoke probation entirely and order you to serve the full original sentence.

A VOP conviction can also lead to extended probation, additional conditions, fines, or other sanctions. Even a first-time technical violation can jeopardize your freedom and future opportunities.

Strong Defenses to Violation of Probation Charges

At Shepard Law, we carefully review every aspect of the State’s case to build a thoughtful defense strategy tailored to your situation. Common and effective defenses include:

  • Insufficient evidence or inaccurate allegations by the probation officer
  • Extenuating circumstances (illness, transportation issues, employment conflicts)
  • Demonstrated efforts toward compliance and rehabilitation
  • Challenges to the lawfulness or fairness of the underlying probation conditions
  • Simultaneous defense of any new criminal charges that triggered the VOP

Stephen P. Shepard approaches each violation of probation case with care and attention, working closely with clients — and often directly with probation officers — to seek the best possible outcome, whether that means continued probation, reduced sanctions, or full dismissal of the violation.
