What Is Malicious Burning?

Under Maryland law, malicious burning of personal property is the willful and malicious setting fire to or burning of personal property belonging to another. In order to convict the defendant of malicious burning, the State must prove:

  1. That the defendant set fire to or burned personal property;
  2. That the personal property, in whole or part, belonged to another; and
  3. That the burning of the property was willful and malicious.

 

“Burning” is the actual combustion or charring by fire. The slightest burning of any part of the property is sufficient. “Willfully” means acting intentionally, knowingly, and purposely. “Maliciously” means acting with the intent to harm others or their property. It is not a defense that the defendant owns the property.

Penalties for Malicious Burning in Baltimore County

Penalties are graded according to the value of damage caused:

  • Damage of $1,000 or more: Misdemeanor punishable by imprisonment not exceeding 3 years or a fine not exceeding $2,500, or both.

 

  • Damage of less than $1,000: Misdemeanor punishable by imprisonment not exceeding 60 days or a fine not exceeding $500, or both.

 

In addition to any sentence, the court may order restitution to the victim and/or community service.
