What Is Rogue and Vagabond Under Maryland Law?

Under Maryland Criminal Law § 6-206, a person commits the offense of rogue and vagabond when they:

  • Possess a burglar’s tool with the intent to use or allow the use of the tool in the commission of a crime involving the breaking and entering of a motor vehicle; or
  • Are in or on the motor vehicle of another with the intent to commit theft of the motor vehicle or property that is in or on the motor vehicle.

 

“Burglar’s tools” are defined in § 6-201(c) and include items such as picklocks, crowbars, pry bars, jacks, explosive materials, or devices capable of burning through metal or concrete. The State must prove possession of the tool(s) and the specific criminal intent, or presence in/on the vehicle coupled with intent to steal.
