What Is Indecent Exposure Under Maryland Criminal Law § 11-107?
Maryland law prohibits the common law crime of indecent exposure. Under § 11-107, “indecent exposure” explicitly includes engaging in an act of masturbation in public, whether or not the person’s genitalia are exposed.
The statute creates two tiers of offenses:
- Standard indecent exposure (subsection (b)): Committing indecent exposure in public.
- Enhanced indecent exposure (subsection (c)): Committing indecent exposure with prurient intent when the person knows or reasonably should know that a minor (at least 2 years old and more than 4 years younger than the defendant) is present.
The law applies only when the conduct occurs in a public place or area where others may reasonably observe it. Peaceable, non-criminal conduct is not covered.
