What Is First-Degree Assault Under Maryland Criminal Law § 3-202?

First-degree assault elevates a second-degree assault by proving one of the following aggravating factors beyond a reasonable doubt:

  1. The defendant used a firearm to commit the assault; or
  2. The defendant intended to cause serious physical injury; or
  3. The defendant intentionally strangled the victim.
 

Strangling” means impeding the normal breathing or blood circulation of another person by applying pressure to the person’s throat or neck. A firearm includes handguns, rifles, shotguns, assault pistols, machine guns, and regulated firearms as defined in the Public Safety Article. Serious physical injury means an injury that creates a substantial risk of death or causes serious and permanent (or protracted) disfigurement, loss, or impairment of the function of any bodily member or organ.

To convict, the State must first prove all elements of second-degree assault and then establish one of the above aggravating factors. Even an attempt to cause serious physical injury can result in a first-degree assault charge.
