What Is Second-Degree Assault Under Maryland Law?

Under Maryland Criminal Law § 3-203, second-degree assault encompasses a broad range of conduct, including:

  • Intentional harmful or offensive physical contact (commonly referred to as battery);
  • An attempt to cause such contact; or
  • Intentionally placing another person in reasonable apprehension of immediate physical harm.

Unlike first-degree assault, second-degree assault does not require the use of a firearm, intent to cause serious physical injury, or strangulation. It covers many everyday altercations, bar fights, domestic disputes, and other situations involving unwanted touching or threats of harm. The State must prove the elements beyond a reasonable doubt, and the charge is often based on the alleged victim’s account.

Special rules apply when the alleged victim is a law enforcement officer, parole or probation agent, or certain other public safety personnel acting in the line of duty, which can elevate penalties.

Penalties for Second-Degree Assault in Baltimore County

Second-degree assault is generally a misdemeanor punishable by:

  • Imprisonment for up to 10 years; and/or
  • A fine of up to $2,500.

When the victim is a law enforcement officer, parole/probation agent, or similar protected person performing official duties, the offense carries enhanced penalties, including a fine of up to $5,000 (while the maximum prison term remains 10 years). Even first-time offenders can face significant collateral consequences, including impacts on employment, housing, and professional licensing.

Strong Defenses to Second-Degree Assault Charges

At Shepard Law, we thoroughly investigate every second-degree assault case to build a thoughtful defense strategy tailored to your situation. Common and effective defenses include:

  • Self-defense or defense of others (reasonable force used to protect yourself or another from imminent harm);
  • Lack of intent or accidental contact;
  • Consent or mutual combat;
  • Insufficient evidence or credibility issues with the complaining witness;
  • Constitutional violations, such as unlawful arrest or search;
  • False accusations or exaggeration of events.
