What Is Theft Under Maryland Criminal Law § 7-104?

Maryland Criminal Law § 7-104 defines several forms of theft, including:

  • Willfully or knowingly obtaining or exerting unauthorized control over property with the intent to deprive the owner;
  • Obtaining control over property by deception with the intent to deprive the owner;
  • Possessing stolen personal property knowing or believing it has been stolen, with the intent to deprive the owner; and
  • Obtaining lost, mislaid, or mistakenly delivered property without taking reasonable steps to return it.

 

The statute also covers theft of services. Penalties are strictly value-based, and the State must prove the elements beyond a reasonable doubt. Even low-value theft can carry criminal consequences, especially for repeat offenders.

Penalties for Theft in Baltimore County

Penalties under § 7-104 depend on the value of the property or services taken:

  • Less than $100: Misdemeanor – up to 90 days in jail and/or a $500 fine (first offense); up to 1 year and/or $500 for subsequent offenses.
  • $100 to less than $1,500: Misdemeanor – up to 6 months/$500 (first) or 1 year/$500 (subsequent), plus restitution.
