Sex Offender Registration Tiers in Maryland

What Are the Sex Offender Registration Tiers in Maryland?

Maryland classifies sex offender registrants into three tiers under Criminal Procedure § 11-701. The tier is determined by the offense of conviction. Tier I registrants register for 15 years and must appear in person every 6 months. Tier II registrants register for 25 years and must appear in person every 6 months. Tier III registrants register for life and must appear in person every 3 months. All three tiers appear on the public registry. Failure to register or to update registration is a separate criminal offense under § 11-721.

What Offenses Fall Under Tier I?

Tier I includes convictions for certain fourth-degree sexual offenses under Criminal Law § 3-308, visual surveillance with prurient intent when the victim is a minor, and possession of child pornography under § 11-208 when the victim is a minor. Attempts and conspiracies count the same as the completed offense. Equivalent offenses from other jurisdictions also trigger Tier I registration. A Tier I registration period can be reduced to 10 years if the registrant meets the statutory conditions under § 11-707, including no new qualifying convictions and completion of any required treatment.

What Offenses Fall Under Tier II?

Tier II includes convictions for certain third-degree sexual offenses, sexual solicitation of a minor, and distribution or production of child pornography under § 11-207. It also includes certain offenses involving minors under the human trafficking and related statutes. Attempts and conspiracies count. Equivalent out-of-state, federal, or military convictions also require Tier II registration. The registration period is 25 years with in-person reporting every 6 months.

What Offenses Fall Under Tier III?

Tier III is reserved for the most serious offenses. It includes first-degree and second-degree rape, first-degree and second-degree sexual offense, and certain other violent sex offenses and child sexual abuse offenses. Attempts and conspiracies count. Equivalent convictions from other jurisdictions also trigger lifetime registration. Tier III registrants must appear in person every 3 months. Sexually violent predators also report every 3 months.

Registration itself is administered by the Maryland Department of Public Safety and Correctional Services. Criminal charges for failure to register under § 11-721 are prosecuted in the courts. Misdemeanor failure-to-register cases begin in District Court in Towson, Essex, or Catonsville. Felony cases, and cases on which a jury trial is prayed, are heard in the Circuit Court for Baltimore County, which sits only in Towson.

What Happens If Someone Fails to Register?

Failure to register or to update registration information is a separate criminal offense under Criminal Procedure § 11-721. The maximum penalty depends on the underlying tier and the number of prior violations. A conviction for failure to register does not erase the underlying registration obligation. Compliance with the registration requirements remains mandatory even while a failure-to-register case is pending.

How often do registrants have to appear in person?

Tier I and Tier II registrants appear every 6 months. Tier III registrants appear every 3 months.

Is failure to register a separate crime?

Yes. Failure to register or to update registration is a separate offense under Criminal Procedure § 11-721.

10/10 This is the Attorney You NEED! You don't need to look any Further. I cannot recommend Stephen Shepard highly enough. When our stressful (out of state) legal situation occurred, I felt overwhelmed and unsure of where to turn. He meet with us right away, on a Saturday. Calmed our nerves with his compassion, professionalism, and incredibly knowledgeable. Without his advice on day one we would have had even more legal trouble. He treated us like family, taking time to explain every detail of the process, keeping me updated and coached us through every step. His communication was impeccable, and always available to answer my questions. What sets him apart is his extensive knowledge, calming confident strategy and connections. He handled negotiations and paperwork with ease, resulting in a favorable outcome that exceeded my expectations! If you are looking for an attorney who is proactive, dedicated, cares and fights for their client Stephen Shepard is the one to call. I am truly grateful for his Expertise!!!
