Probation Matters Lawyer Towson – Defending Violation of Probation Cases in Baltimore County
Violation, Modification, and Early Termination Defense in Towson, Essex, and Catonsville
Probation is not a closed case. It is a court order that can send a person back to jail on the original sentence if the court finds a violation. In Baltimore County those hearings are held in the court that imposed the probation—District Court in Towson, Essex, or Catonsville, or the Circuit Court in Towson. The standard of proof is lower than a criminal trial. The exposure is often the time that was suspended at sentencing.
Maryland Criminal Procedure § 6-223 governs how a court responds to an alleged violation and when it may end probation. Maryland Rule 4-346 governs modification of conditions and duration while probation is still running. Those two authorities are not the same motion, and they are not heard the same way.
At Shepard Law in Towson, principal attorney Stephen P. Shepard provides client-centered and compassionate criminal defense representation to individuals facing probation matters throughout Baltimore County. With more than a decade of dedicated service defending clients in Towson, Essex, Catonsville, and surrounding communities, our firm focuses on understanding your unique circumstances and protecting your future with thoughtful, personalized advocacy.

A probation warrant does not wait for a convenient week. A modification or early-termination motion is stronger when it is filed with a clean compliance record and proof of what has changed—not after a missed appointment becomes a charged violation. Call before the next report date if the conditions no longer match the facts.
Call Shepard Law at (410) 648-4008 or complete our secure online contact form for a free, confidential consultation. We also offer jail visits for a fee when needed. Attorney Stephen P. Shepard is prepared to listen carefully to your story, explain your rights, and provide the client-centered and compassionate representation you deserve.

Dedicated pages on this site address several of these procedures in more detail.
- Violation of probation. A charged violation starts with written allegations under oath. The court may issue a warrant or a notice to appear. Pending the hearing, the court may hold the person or release the person with or without bail.
- Technical versus non-technical violations. Maryland law treats a missed report or a failed test differently from a new crime, absconding, or a no-contact violation. The first three technical violations carry presumptive jail caps of 15, 30, and 45 days. A fourth technical violation, or a violation that is not technical, can expose the person to any sentence that could have been imposed on the original charge.
- Modification of conditions. Under Rule 4-346, the court may change reporting, travel, monitoring, treatment, or the length of supervision while probation is still running. See Shepard Law’s modification-of-probation page.
- Early termination. Section 6-223(a) allows a District Court or Circuit Court judge to end probation at any time. There is no automatic minimum term in the statute. Judges look at compliance, restitution, treatment, and whether supervision is still doing useful work. See Shepard Law’s early-termination page.
- Release pending a violation hearing. A VOP warrant can mean a hold until the sentencing judge is available. Counsel can seek release and prepare the hearing at the same time.
If the original disposition was probation before judgment under § 6-220, a violation can also mean the court enters judgment on the underlying charge. That is a different consequence from serving suspended time on a sentence that was already imposed.

Can I go to jail for missing a probation appointment?
A missed report is typically a technical violation. A first technical finding carries a presumptive cap of 15 days. The court can still continue probation with no jail. A fourth technical finding, or a finding that the cap should not apply, changes that picture.
Is a new arrest automatically a probation violation?
A new charge is generally not a technical violation. If the court finds a non-technical violation, the presumptive 15/30/45-day caps do not apply, and the original suspended sentence is in play. The new case and the VOP are still two separate proceedings.
Can probation be ended early in Baltimore County?
Yes. Section 6-223(a) allows the sentencing court to end probation at any time. Judges look at compliance, unpaid restitution, and whether supervision is still needed. There is no automatic right to early termination.
