Crimes Against the Public Lawyer in Baltimore County, Maryland

Experienced Defense Against Public-Order and Public-Administration Charges in Towson

If you or a loved one has been charged with a crime against the public in Baltimore County, Maryland, the case is usually a must-appear misdemeanor that started with a street encounter, a bar argument, a loud-noise complaint, or a stop that escalated. Shepard Law groups these matters together because they share a common fact pattern: an officer’s version of what happened in public, often with little physical evidence beyond a report and body-worn camera.

Maryland does not put every public-order offense in one title. Disorderly conduct and disturbing the peace live in Criminal Law Title 10. Resisting arrest, interfering with an officer, and false statements to police live in Title 9. Indecent exposure is in Title 11. Rogue and vagabond is a Title 6 property offense that the firm also defends from this hub because it is so often charged from the same kind of public stop.

At Shepard Law in Towson, principal attorney Stephen P. Shepard provides client-centered and compassionate criminal defense representation to individuals facing public-order charges throughout Baltimore County. With more than a decade of dedicated service defending clients in Towson, Essex, Catonsville, and surrounding communities, our firm focuses on understanding your unique circumstances and protecting your future with thoughtful, personalized advocacy.

A public-order charge in Towson District Court can look minor on paper and still produce a criminal record, jail exposure, and a second count for resisting arrest if the stop went badly. Early counsel lets us review the body-worn camera before the officer’s narrative becomes the only version of the event.

Call Shepard Law at (410) 648-4008 or complete our secure online contact form for a free, confidential consultation. We also offer jail visits for a fee when needed. Attorney Stephen P. Shepard is prepared to listen carefully to your story, explain your rights, and provide the client-centered and compassionate representation you deserve.

Public-Order Charges Shepard Law Defends

This hub covers the offenses most often charged after a public disturbance encounter with the police in Baltimore County. Dedicated child pages address several of these statutes in more detail.

Companion charges on the same citation often include second-degree assault, assault on a law enforcement officer, CDS possession, or a traffic offense that started the stop. Those related counts should be handled together.

We frequently achieve favorable results through skilled negotiation or by presenting a strong defense at trial when necessary. Our goal remains to safeguard your freedom, record, and future.

Section 10-201 is broader than the phrase “disorderly conduct” suggests. A public place or public conveyance need not be devoted solely to public use. The statute reaches streets, sidewalks, parks, restaurants, shopping centers, hotels, schools, places of worship, and common areas of multi-unit dwellings. Every prohibited act must be willful. Accidental noise or an unintended obstruction is not the offense.

The failure-to-obey theory is the one that most often converts a conversation with an officer into a criminal charge. The order must be reasonable and lawful, and it must have been made to prevent a disturbance to the public peace. An order that goes beyond that purpose, or that is used to punish speech the officer dislikes, is open to challenge. First Amendment protections are a live issue in many Towson disorderly-conduct cases, particularly near Towson University and downtown Towson.

Resisting arrest is not a lesser version of assault on a police officer. It is its own misdemeanor. The State must prove that the accused intentionally resisted a lawful arrest, or intentionally interfered with an officer making or attempting a lawful arrest or detention of another person. The unit of prosecution is the arrest or detention, not the number of officers involved.

“Lawful arrest” is an element. If the underlying arrest was not lawful, the resisting count can fail even if the encounter was ugly. Passive noncompliance, an argument, or an instinctive reaction to pain is not automatically intentional resistance. Body-worn camera usually decides these cases. A lawyer should obtain that footage before the first court date.

A false-statement charge under § 9-501 requires a statement the person knows is false in whole or in a material part, made to a law enforcement officer with intent to deceive and to cause an investigation or other action. Giving a wrong name or date of birth after an arrest can be charged under the companion identity statute. These are 6-month misdemeanors, but they travel with the original case and can destroy credibility if they are not addressed early.

Strong Defenses to Public-Order Charges

At Shepard Law, we thoroughly investigate every public-order case to build a thoughtful defense strategy tailored to your situation. Common issues include:

  • The conduct was not willful. Section 10-201 requires willfulness. Raised voices, accidental contact, or a reaction to being startled is not automatically disorderly conduct.
  • The officer’s order was not reasonable, lawful, or issued to prevent a disturbance. Failure-to-obey is not a general command to be silent or to leave public property.
  • Protected speech. Criticism of the police, protest activity, and loud public debate are not crimes because they are unpopular.
  • The underlying arrest was not lawful. A § 9-408 count depends on a lawful arrest or detention.
  • No intent to resist or deceive. Confusion, intoxication, language barriers, and pain responses are not the same as intentional resistance or a knowing false statement.
  • The camera does not match the report. Body-worn camera is often the best evidence in these cases. Watch it before anyone pleads.

Stephen P. Shepard approaches each case with care and attention, working closely with clients to pursue the most appropriate resolution—whether dismissal, a stet, probation before judgment where available, a reduction that drops the resisting count, or a trial.
