Fleeing and Eluding the Police Lawyer in Baltimore County, Maryland

Experienced Defense Against Fleeing and Eluding Charges in Towson and Baltimore County

If you or a loved one has been charged with fleeing and eluding the police in Baltimore County, Maryland, you face a serious must-appear traffic offense under Maryland Transportation Article § 21-904. This is not a payable ticket. A conviction can mean jail time, a substantial fine, 12 points on a Maryland driving record, and Motor Vehicle Administration action that can revoke a license. Prosecutors in Baltimore County District Court treat these cases as criminal matters, and they are often charged together with reckless driving, DUI, driving while suspended, or leaving the scene of an accident.

At Shepard Law in Towson, principal attorney Stephen P. Shepard provides client-centered and compassionate criminal defense representation to individuals facing fleeing and eluding charges throughout Baltimore County. With more than a decade of dedicated service defending clients in Towson, Essex, Catonsville, and surrounding communities, our law firm focuses on understanding your unique circumstances and protecting your future with thoughtful, personalized advocacy.

What Is Fleeing or Eluding Police Under Maryland Law?

Section 21-904 appears in the Vehicle Laws — Rules of the Road. It creates two independent charging theories. A driver may not attempt to elude a police officer who has given a visual or audible signal to stop if:

  • The officer is in uniform and prominently displaying a badge or other insignia of office (§ 21-904(b)); or
  • The officer, whether or not in uniform, is in a vehicle appropriately marked as an official police vehicle (§ 21-904(c)).

A “visual or audible signal” includes a signal by hand, voice, emergency light, or siren. Eluding may be charged as willfully failing to stop the vehicle, fleeing on foot, or attempting to elude by any other means.

The word “willfully” is central. The State must prove that the driver knew a signal to stop had been given and chose not to comply. A delayed stop to reach a lighted, populated place, a genuine failure to see or hear the signal, or confusion about whether the vehicle behind was a marked police car can all bear on that element. The statute does not punish every imperfect stop. It punishes a willful attempt to elude.

How These Cases Typically Arise in Baltimore County

Fleeing and eluding charges in Towson commonly follow a traffic stop that did not end when the officer expected it to end. Typical fact patterns include:

  • Continuing to drive after emergency lights or a siren are activated;
  • Stopping briefly and then driving away;
  • Leaving the vehicle and running;
  • A short “failure to yield” that the officer writes as an attempt to elude rather than as a lesser traffic violation; and
  • A stop that begins as speeding, a suspected DUI, or a suspended-license inquiry and then expands after the driver does not pull over immediately.

Related charges frequently appear on the same citation or statement of charges: reckless driving under § 21901.1, negligent driving, driving while suspended or revoked, DUI or DWI under § 21-902, leaving the scene of an accident, and, when a foot flight is involved, resisting arrest or disobeying a lawful order under § 21-103. A fleeing and eluding lawyer in Towson should read the entire charging package, not only the § 21-904 count.

License Points and MVA Consequences

A conviction for fleeing or attempting to elude a police officer assesses 12 points under Transportation Article § 16-402. Twelve points in a two-year window is the Motor Vehicle Administration’s revocation threshold under § 16-404. In practical terms, a single fleeing and eluding conviction can revoke a Maryland license even if the court imposes little or no jail time.

MVA action is separate from the criminal sentence. A favorable court result—dismissal, a stet, a reduction to a lower-point offense, or, where available, probation before judgment—can be the difference between keeping and losing driving privileges. Commercial drivers, rideshare drivers, and anyone whose work depends on a license should treat the points exposure as a central issue, not an afterthought.

What the State Must Prove

To convict a driver of fleeing or eluding police in Baltimore County, the prosecution generally must establish:

  • That the defendant was driving a vehicle;
  • That a police officer gave a visual or audible signal to stop;
  • That the officer was either in uniform and displaying a badge or other insignia, or in a vehicle appropriately marked as an official police vehicle; and
  • That the defendant willfully attempted to elude the officer by failing to stop, fleeing on foot, or some other means.

For an enhanced count, the State must also prove bodily injury, death, or the crime-of-violence apprehension purpose plus a later conviction for that crime of violence. Video from the cruiser and from body-worn cameras, radio traffic, and the timing of when lights or the siren were activated are often more important than the officer’s later summary of the event.

Strong Defenses to Fleeing and Eluding Charges

At Shepard Law, we thoroughly investigate every fleeing and eluding case to build a thoughtful defense strategy tailored to your situation. Common and effective defenses include:

  • No willful attempt to elude. A late stop, a search for a safe shoulder, poor weather, or a short delay before pulling over is not the same as a willful effort to escape.
  • No qualifying signal, uniform, badge, or marked vehicle. An unmarked car, an officer not in uniform and not in a marked cruiser, or a signal that was not reasonably perceptible can defeat an element of the statute.
  • Identification and operation. The State must prove the accused was the driver. Passenger claims, borrowed cars, and weak video identification are triable.
  • Suppression and related-charge strategy. An unlawful stop or an overcharged companion count— reckless driving, DUI, or resisting—can change the leverage in Towson District Court.

Stephen P. Shepard approaches each case with care and attention, working closely with clients to pursue the most appropriate resolution—whether through negotiation for dismissal, reduction to a lower-point traffic offense, a disposition that protects the license, or trial.
