First Degree Assault Lawyer in Baltimore County, Maryland

If you or a loved one has been charged with first-degree assault in Baltimore County, Maryland, you face one of the most serious violent felony charges under state law. Maryland Criminal Law § 3-202 classifies first-degree assault as a felony punishable by up to 25 years in prison. Prosecutors treat these cases aggressively because the offense is designated a “crime of violence,” which can trigger mandatory minimum sentences for repeat offenders and lifelong collateral consequences including loss of firearm rights, employment barriers, and housing restrictions.

What Is First-Degree Assault Under Maryland Criminal Law § 3-202?
First-degree assault elevates a second-degree assault by proving one of the following aggravating factors beyond a reasonable doubt:
- The defendant used a firearm to commit the assault; or
- The defendant intended to cause serious physical injury; or
- The defendant intentionally strangled the victim.
“Strangling” means impeding the normal breathing or blood circulation of another person by applying pressure to the person’s throat or neck. A firearm includes handguns, rifles, shotguns, assault pistols, machine guns, and regulated firearms as defined in the Public Safety Article. Serious physical injury means an injury that creates a substantial risk of death or causes serious and permanent (or protracted) disfigurement, loss, or impairment of the function of any bodily member or organ.
To convict, the State must first prove all elements of second-degree assault and then establish one of the above aggravating factors. Even an attempt to cause serious physical injury can result in a first-degree assault charge.
Penalties for First-Degree Assault in Baltimore County
A conviction for first-degree assault is a felony carrying:
- Up to 25 years imprisonment
- Classification as a crime of violence, subjecting repeat offenders to mandatory minimum sentences under Maryland Criminal Law § 14-101 (10 years for a second offense, 25 years for a third, and life without parole for a fourth)
Courts may also impose lengthy probation, restitution, and mandatory counseling. A felony conviction permanently affects firearm ownership, professional licenses, employment, and immigration status.
Strong Defenses to First-Degree Assault Charges
At Shepard Law, we conduct a thorough, independent investigation of every case to build the strongest possible defense. Common and effective strategies include:
- Self-defense or defense of others — The use of reasonable force was legally justified
- Lack of intent — No evidence the defendant intended serious physical injury or strangulation
- Insufficient evidence of serious physical injury — The alleged injury does not meet the statutory definition
- False identification or witness credibility issues
- Unlawful search, seizure, or Miranda violations
- Negotiation for reduction to second-degree assault or other misdemeanors
Attorney Stephen P. Shepard aggressively challenges the State’s evidence at every stage and fights for dismissal or the most favorable resolution possible.
