Warrant Recall Lawyer Towson – Resolving Bench Warrants and Failure to Appear Issues in Baltimore County
Bench Warrants and Missed Court Dates in Towson, Essex, and Catonsville
If you missed a court date in Baltimore County, Maryland, the problem is often already two problems. The court may have issued a bench warrant for your arrest. If the missed case was a traffic matter, the Motor Vehicle Administration may also have started a license suspension.
A Maryland bench warrant does not expire. It stays active until the court that issued it recalls it. The next traffic stop, workplace check, or background search can turn a missed date into an arrest. Shepard Law’s work on these files is to get the warrant in front of the right judge, in the right courthouse, and get a new court date set.
At Shepard Law in Towson, principal attorney Stephen P. Shepard provides client-centered and compassionate criminal defense representation to individuals facing bench warrants and failure-to-appear issues throughout Baltimore County. With more than a decade of dedicated service defending clients in Towson, Essex, Catonsville, and surrounding communities, our firm focuses on understanding your unique circumstances and protecting your future with thoughtful, personalized advocacy.

What is a Bench Warrant
A bench warrant is an arrest order issued by a judge because a required appearance was missed. It is not the original charge. It is a separate court order that authorizes law enforcement to take the person into custody and bring them before the court.
How the missed date is charged depends on what kind of case it was:
- Criminal citations and many non-traffic cases — Criminal Procedure § 5-212. A bench warrant may issue. Failure to appear in response to a covered citation is a misdemeanor punishable by up to 90 days in jail, a $500 fine, or both. This section does not apply to parking citations, to the standard traffic citation form adopted by the Chief Judge of the District Court, or to certain Natural Resources citations.
- Traffic cases — Transportation Article § 26-204. On a must-appear traffic charge, the court may issue an arrest warrant under subsection (c)(1). The court may also notify the MVA of noncompliance. The MVA can then suspend the license after the statutory notice period. Appearance by counsel is expressly allowed under subsection (b) in many of these matters.
A missed DUI or other must-appear traffic date is generally handled under § 26-204, not as a separate § 5-212 misdemeanor. The warrant and the damage to the underlying case are still serious. Driving after the MVA has suspended the license can add a driving-while-suspended charge on top of the warrant.
Consequences of Leaving a Warrant Outstanding
- Arrest at a traffic stop, at home, or at work.
- A night in the detention center before a judge is available.
- A higher bond, or a no-bond hold, on the original charge.
- A separate failure-to-appear count when § 5-212 applies.
- An MVA suspension, and a later suspended-license charge if the person keeps driving.
- Damage to employment, housing, licensing, and later expungement or probation-before-judgment options.
